Before using the ORLOV.com website (the “Website”), please review all of the terms below. The Terms and Conditions of Use (“Use Terms”), the Terms and Conditions of Sale (“Sale Terms”), and the Additional Terms, together with the Privacy Policy, govern your use of the Website and any purchase you make or attempt to make. If you do not agree to these terms, please do not use the Website.

ORLOV Monte Carlo SARL (“ORLOV,” “we,” “us”) may update these terms at any time without prior notice. The most current version is always available at www.orlov.com/pages/terms-of-sale. By continuing to use the Website after any update, you accept the current terms.

B. TERMS AND CONDITIONS FOR THE USE OF THE WEBSITE

(1) GENERAL. All use of the Website is subject to these Use Terms. By using the Website you agree to comply with and be bound by them.

(2) PRIVACY. The ORLOV Privacy Policy governs the use of any personal information you provide on, or that is collected through, the Website.

(3) NOT INTENDED FOR MINORS. The Website is not intended for those under 18. By using it you confirm you are 18 or older. We do not knowingly collect personal information from those under 18.

(4) INTELLECTUAL PROPERTY. The Website and all material on it — including all intellectual property of any nature, whether registered or unregistered, such as drawings, designs, illustrations, photographs, videos, written text, logos, and trademarks — are the exclusive property of ORLOV and its affiliates. You may not reproduce, distribute, publish, transmit, create derivative works from, modify, or sell any material on the Website. The “ORLOV” trademark and all related marks and logos, and the domain name “orlov.com,” remain the exclusive property of ORLOV.

(5) LINKING. The Website may contain links to third-party sites not controlled by ORLOV, provided for convenience only and without endorsement. You may link to the Website only with our prior written authorisation.

(6) USE RESTRICTIONS. You may not use any automated device or process to scrape, copy, or monitor any part of the Website; attempt to gain unauthorised access to any part of the Website or connected systems; interfere with the proper working of the Website; or use the Website for any unlawful purpose.

C. TERMS AND CONDITIONS OF SALE

The purchase or attempted purchase of any product offered on the Website is subject to these Sale Terms. For each order, your acceptance of the Sale Terms in force at the date of the order is required.

(1) PURCHASE — GENERAL TERMS

(A) PERSONAL USE. Orders may be placed for personal use and not for resale. Any resale or distribution of ORLOV products purchased on the Website is prohibited.

(B) WORLDWIDE AVAILABILITY. The Website may be used to order a selection of ORLOV products for delivery worldwide. Not all products may be shipped to all locations; if you attempt to purchase a product that cannot be shipped to your location, the ORLOV Concierge will contact you.

(C) PRICE-ON-REQUEST PIECES. Certain creations are presented by request only and are arranged personally through the ORLOV Concierge rather than standard checkout. You may reach the Concierge via WhatsApp at +377 6 43 91 00 92 or by booking a private appointment.

(D) RIGHT TO CANCEL. ORLOV reserves the right to cancel any order in its sole discretion and without liability, including where it has a dispute with a customer concerning a prior order, has reasonable cause to suspect a violation of these Sale Terms or fraudulent activity, or for any other reason.

(E) AVAILABILITY. All offers of products are subject to availability. ORLOV reserves the right to change the items offered at any time without notice. If a product is unavailable after you place your order, you will be informed and may order a substitute, wait until it is available, or cancel for a full refund of any amount charged.

(F) AGE. You must be 18 or older to make a purchase, and by purchasing you represent that you are.

(G) ACCOUNT. Certain features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and agree to notify ORLOV immediately of any unauthorised use.

(2) PURCHASE — CONFIRMATION

(A) ORDER SUMMARY. For each product selected, a summary page displays the item, its references, the unit price, the quantity, and the total amount owed. Please confirm this information before placing your order. Once confirmed, your order is submitted for processing.

(B) VISUAL ACCURACY. While we take care to represent the colour, design, and style of ORLOV products accurately, variations may occur due to technical restrictions of colour reproduction on your device. ORLOV is not liable for such variations; if you have any questions about a product, please contact the Concierge.

(C) SUBMITTED ORDERS. Once submitted for processing, an order may not be amended or cancelled except as provided herein or under applicable law. Placing an order confirms your acceptance of these Sale Terms, and you will receive an order summary by email.

(3) PURCHASE — PRICING AND PAYMENT

(A) PRICE. Prices on the Website are in Euros. Within the European Union, prices are inclusive of applicable taxes. For destinations outside the European Union, import duties, taxes, and customs charges are determined by the destination country; the allocation of responsibility for such charges is confirmed by ORLOV before dispatch. ORLOV reserves the right to modify prices at any time without prior notice; you are charged the price displayed at the time your order was confirmed.

(B) PAYMENT. Payment is required upon confirmation of your order. Your order is processed for shipment once your payment method has been verified and authorised. For price-on-request and high-value pieces, payment arrangements are confirmed with the ORLOV Concierge.

(C) TITLE AND RISK. Title and risk pass to the client upon delivery. In the event of a payment dispute, you are required to return the products concerned to ORLOV immediately upon request.

(4) SHIPPING AND DELIVERY

(A) DELIVERY. ORLOV delivers worldwide. All pieces are dispatched fully insured and tracked, in tamper-evident packaging, with signature required on delivery.

(B) TIMING. Finished pieces in stock are dispatched within 2–5 business days. One-of-a-kind, made-to-order, and engraved pieces follow a timeline confirmed by your ORLOV Concierge at the time of order.

(C) TAXES & DUTIES. Orders delivered within the European Union are inclusive of applicable taxes. For orders delivered outside the European Union, import duties, taxes, and customs fees are determined by the destination country; the allocation of responsibility for such charges is confirmed in writing by ORLOV prior to dispatch.

(D) DELIVERY PROBLEMS. Please check that your shipment is correct on delivery. Any discrepancy, damage, or delivery failure should be reported to the ORLOV Concierge as soon as possible.

(5) RETURNS AND EXCHANGES

(A) RETURNS. Stock pieces may be returned within fourteen (14) calendar days of delivery, provided they are unworn, undamaged, and returned in their original ORLOV packaging with all accompanying certificates and documentation. All returns must be pre-authorised by the ORLOV Concierge and returned fully insured by a method agreed with the Concierge; ORLOV cannot accept liability for pieces returned by uninsured or untracked means. Once received and inspected, refunds are issued to the original payment method.

(B) NOT ELIGIBLE FOR RETURN. Made-to-order, bespoke, engraved, or personalised creations, and price-on-request pieces, are final sale except where they arrive damaged or not as described.

(C) FRAGRANCE AND COSMETIC PRODUCTS. For fragrance and cosmetic products to be returned, they must be unopened and in their original packaging with any protective film intact. If the film has been opened or removed, the item cannot be accepted for return or exchange except where it arrives damaged or not as described.

(D) REFUND. ORLOV will use commercially reasonable efforts to issue any refund within ten (10) business days of receipt and inspection of the returned goods. All refunds are made to the original form of payment.

D. ADDITIONAL TERMS

(1) TERMINATION OF ACCESS. ORLOV may, in its sole discretion and without prior notice, terminate or suspend your access to the Website if it determines that you have violated any of these terms.

(2) DISCLAIMER OF WARRANTIES. The Website and its contents are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, ORLOV disclaims all warranties, express or implied, with respect to the Website, except for any warranties that apply to the ORLOV products themselves and that cannot be excluded under applicable law.

(3) LIMITATION OF LIABILITY. To the fullest extent permitted by applicable law, ORLOV shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Website. Nothing in these terms limits any liability that cannot be limited or excluded under applicable law.

(4) GOVERNING LAW AND DISPUTES. These terms are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict-of-laws principles. The courts of Luxembourg City shall have jurisdiction over any dispute arising out of or relating to these terms, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

(5) MISCELLANEOUS. If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force. No failure or delay by ORLOV in enforcing any right constitutes a waiver of that or any other right. Headings are for convenience only.
